Welcome to myHMR ("we," "our," or "us"). These Terms of Service ("Terms") govern your access and use of our platform, applications, and services (collectively, the "Services"). By using our Services, you agree to be bound by these Terms.
Eligibility
- You must be at least 18 years old and a qualified healthcare professional (e.g., pharmacist, doctor, nurse, or other credentialed professional) to use myHMR.
- By using the Services, you represent that you meet these requirements.
Use of Services
- You may only use the Services for lawful purposes and in compliance with healthcare and privacy regulations applicable in your jurisdiction.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Data & Security
- We use industry-standard security measures, including encryption in transit and at rest, secure servers hosted in AWS Sydney (Australia), and restricted access.
- We retain data for 12 months, after which it will be permanently deleted.
- In the event of a data breach, we will notify you within 72 hours in line with GDPR-style obligations.
- Despite our safeguards, no system is completely secure. By using the Services, you accept these risks.
Professional Responsibility
- myHMR is a report-writing software only. It does not replace professional clinical judgment.
- You remain legally responsible for ensuring the accuracy and compliance of any reports generated through our Services.
Limitation of Liability
- To the fullest extent permitted by law:
- myHMR Pty Ltd, its directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill.
- Our liability is strictly capped to the fees you have paid us for the period in which the claim arose.
- If you disagree with these limitations, your sole remedy is to discontinue use of the Services.
Third-Party Services
- Our Services may incorporate third-party plugins, APIs, and large language models.
- We do not control these services and are not responsible for their availability, accuracy, or compliance.
Marketing & Communications
- By signing up, you agree to receive essential service communications via email and SMS (e.g., security, account, compliance notices).
- You may opt out of non-essential marketing communications at any time.
Termination
We may suspend or terminate your account if you breach these Terms. You may terminate your account at any time.
Governing Law
These Terms are governed by the laws of Victoria, Australia, and any disputes will be resolved under the exclusive jurisdiction of Victorian courts.
We may update these Terms periodically. Any changes will be posted here with a new "Last Updated" date.
